第一章 总 则
Chapter 1 General Provisions
第一条 为适应海南全面深化改革开放需要，放宽境外人员为海南自由贸易港内企业和居民直接提供专业服务的限制，加快推进海南自由贸易港建设，根据《海南自由贸易港建设总体方案》有关精神，结合海南实际，制定本办法。
Article 1 In order to meet the needs of Hainan’s comprehensive deepening of reform and opening up, relax restrictions on overseas personnel in providing professional services directly to enterprises and residents within the Hainan Free Trade Port (hereinafter referred to as the Port), and accelerate the construction of the Port, these Measures are formulated in accordance with the relevant spirit of the Master Plan for the Construction of Hainan Free Trade Port and in combination with the actual condition of Hainan.
第二条 以境外职业资格名义直接为海南自由贸易港内企业和居民提供相关专业服务的境外人员适用本办法。
Article 2 These Measures are applicable to overseas personnel who directly provide enterprises and residents within the Port with relevant professional services in the name of overseas professional qualifications.
本办法所称的境外人员是指已被海南自由贸易港用人单位聘用且已取得境外职业资格的境外人员。
Overseas personnel referred to as in these Measures refer to those overseas personnel who have been employed by employers within the Port and have obtained overseas professional qualifications.
本办法所称的境外职业资格是指境外政府或机构设置的所涉职业关系公共利益或公共安全、人身健康、生命财产安全的职业资格（注册会计师、法律服务等除外）。
Overseas professional qualifications referred to as in these Measures refer to those professional qualifications relating to the public interests or public security, personal health, life and property security of occupations established by overseas governments or institutions (except for certified public accountants, legal services, etc.).
第三条 省委人才工作部门和省人力资源社会保障部门会同省级相关行业主管部门根据海南自由贸易港建设需要制定认可境外职业资格目录清单，并实行动态调整。
Article 3 According to the construction needs of the Port, the Talents Department of the Provincial Party Committee and Human Resources and Social Security Department of Hainan Province, in conjunction with relevant provincial-level industry authorities, have formulated a list of approved overseas professional qualifications, and implemented dynamic adjustments.
第四条 境外人员以目录清单内的境外职业资格名义直接为海南自由贸易港内企业和居民提供相关专业服务前，须符合有关条件并通过技能认定，取得《海南自由贸易港境外人员技能认定合格证》。
Article 4 Before overseas personnel directly provide relevant
professional services enterprises and residents within the Port in the name of overseas professional qualifications within the approved list, they shall meet relevant requirements and pass the skill certification, and obtain the Skill Certification Certificate of Overseas Personnel in the Hainan Free Trade Port.
第二章 认 定
Chapter 2 Skills Certification
第五条 省级行业主管部门是本行业境外人员技能认定的组织实施部门，负责制定本行业境外人员技能认定标准。
Article 5 As the department that organizes the implementation of skill certification for overseas personnel in the industry, the provincial-level industry authorities shall be responsible for formulating the standards for qualification for overseas personnel in the industry.
第六条 遵守中华人民共和国宪法、法律法规，具有完全民事行为能力和良好的职业道德，并已取得海南省有关部门核发的有效工作许可证的境外人员，均可申请参加技能认定。
Article 6 Overseas personnel who comply with the Constitution, laws, and regulations of the People’s Republic of China, have full capacity for civil conduct and good professional ethics, and have obtained a valid work permit issued by relevant departments of Hainan Province, can apply for the skills certification.
第七条 境外人员的技能认定，可选择采用材料审核、答辩、考试或评审等方式进行，具体方式由省级行业主管部门确定。
Article 7 The skill certification process of overseas personnel can be
carried out by means of material review, reply, examination, or appraisal, etc. The specific method shall be determined by the provincial-level industry authorities.
第八条 境外人员的技能认定按照下列程序进行：
Article 8 The skill certification of overseas personnel shall be carried out through the following procedures:
（一）申请。申请技能认定的境外人员，由聘用单位向省级人才服务一站式窗口申报，并提交申请人的聘用协议或劳动合同、境外职业资格证书（由翻译公司出具的中文翻译文本）、专业服务范围和聘用单位对其境外职业资格真实性、有效性的承诺书等材料。
(I) Application. For overseas personnel applying for skills certification, the employers shall declare to the provincial one-stop window for talent services and submit the applicant’s employment agreement or labor contract and overseas professional qualification certificate (Chinese translation text issued by a translation service provider), professional services scope and employers ’ letter of commitment of the authenticity and validity of their overseas professional qualifications and other materials.
（二）受理。省级人才服务一站式窗口对申报材料进行初审，材料齐全的，予以受理；材料不齐全的，应一次性告知申请单位需要补正的材料；不符合条件、不予受理的，应当说明理由。省级人才服务一站式窗口自受理之日起，2 个工作日内将受理材料移交省级行业主管部门。
(II) Acceptance. The provincial one-stop window for talent services
shall conduct a preliminary review on the application materials and accept those with complete materials; in the event of incomplete materials, the applicant shall be informed of the materials to be supplemented and corrected at one time; if not qualified and not accepted, the reasons shall be given. In addition to this, the acceptance materials will be handed over to the provincial-level industry authorities within two (2) working days of the date of acceptance.
（三）认定。省级行业主管部门对申请人进行技能认定，并在受理之日起 20 个工作日内对申请人是否通过技能认定作出决定。对通过技能认定的，根据其技能水平等情况确定其专业服务范围；对不通过技能认定的，书面说明理由，并退回申请材料。
(III) Certification. The provincial-level industry authorities shall conduct skills certification on the applicant, and decide on whether or not the applicant passes the skills certification within 20 working days from the date of acceptance. For those who pass the skills recognition, the scope of professional services shall be determined according to their skill level, etc; for those who fail to pass the skills recognition, the reasons shall be given in writing and the application materials shall be returned.
（四）发证。省级行业主管部门对通过技能认定的境外人员颁发《海南自由贸易港境外人员技能认定合格证》，并在合格证上备注其专业服务范围和有效期限。
(IV) Issue Certificate. The provincial-level industry authorities shall issue the Skill Certification Certificate of Overseas Personnel in the Hainan Free Trade Port to those overseas personnel who pass the skills
certification, and indicate the scope and professional services and term of validity on the certificate.
第九条 《海南自由贸易港境外人员技能认定合格证》是表明境外人员具备在海南自由贸易港内从事相关专业服务的有效凭证，由本人保管、使用。
Article 9 The Skill Certification Certificate ofOverseas Personnel in the Hainan Free Trade Port serves as a valid certificate indicating that the overseas personnel are qualified to provide relevant professional services within the Port, which shall be kept and used by themselves.
《海南自由贸易港境外人员技能认定合格证》，由省级行业主管部门按照全省统一样式进行印制。
The Skill Certification Certificate of Overseas Personnel in the Hainan Free Trade Port is printed by provincial-level industry authorities in the standard format throughout the province.
第三章 执 业
Chapter 3 Practice
第十条 持有《海南自由贸易港境外人员技能认定合格证》的境外人员（以下简称“境外持证人员”），在规定的专业服务范围和期限内与省内同类专业人员具有同等权利。
Article 10 Overseas personnel who hold the Skill Certification Certificate of Overseas Personnel in the Hainan Free Trade Port (hereinafter referred to as “Overseas Certified Personnel”) are entitled to the same rights as similar professionals in Hainan Province within the scope and terms of professional services as specified.
境外持证人员提供需加盖国内执业印章的专业服务时，由境外人员签字并加盖其聘用单位的印章，海南自由贸易港内相关主管部门应当予以认可。
When Overseas Certified Personnel provide professional services to be affixed with the domestic practice seal, the overseas personnel shall sign and affix the seal of their employers, which shall be recognized by the relevant authorities within the Port.
第十一条 境外持证人员在海南自由贸易港内从事相关专业服务活动时，应履行下列义务：
Article 11 Overseas Certified Personnel shall perform the following obligations when they are engaged in relevant professional services within the Port:
（一）在规定的专业服务范围内提供服务；
(I) Provide services within the scope of professional services as specified;
（二）遵守中华人民共和国法律法规相关规定和职业道德，确保服务质量，维护公共利益；
(II) Comply with relevant provisions of laws and regulations of the People’s Republic of China and professional ethics, ensure quality of services, and maintain public interests;
（三）保守在专业服务中知悉的单位和个人秘密；
(III) Keep secrets of the enterprises and individuals known in professional services strictly confidential;
（四）省级行业主管部门规定的其他义务。
(IV) Other obligations specified by provincial-level industry authorities.
第四章 监 管
Chapter 4 Regulation
第十二条 行业主管部门依照本办法规定，对境外持证人员专业服务活动进行监督检查。实施监督检查时，可以询问当事人专业服务的有关情况，查阅相关资料，有关单位和个人应当配合。
Article 12 The industry authorities shall supervise and inspect the professional service activities carried out by Overseas Certified Personnel. In the process of supervision and inspection, the industry authorities may inquire the parties involved about the professional services and consult relevant information, and relevant enterprises and individuals shall cooperate.
第十三条 聘用单位应建立境外持证人员专业服务信用档案。信用档案，包括境外持证人员的基本情况、业绩、良好行为及不良行为等内容。违规行为、被投诉举报和行政处罚等情况应作为境外持证人员的不良行为记入其专业服务信用档案。
Article 13 Employers shall establish credit files of professional services for Overseas Certified Personnel. The files include basic information, performance, good conduct, and bad conduct of Overseas Certified Personnel. Violations, complaints or reports and administrative punishments shall be recorded in the professional service credit files as bad conduct of Overseas Certified Personnel.
聘用单位应于每年年底向省级行业主管部门报送本单位聘用的
境外持证人员专业服务信用情况。
Employers shall submit the Overseas Certified Personnel’s credit standing of professional services to the provincial-level industry authorities at the end of each year.
第十四条 境外人员违反本办法规定，未经技能认定擅自从事相关专业服务，或超范围从事相关专业服务的，有关行业主管部门不予认可，并参照省内未取得职（执）业资格擅自执业或者超执业范围承揽业务的规定予以处理。
Article 14 Where the overseas personnel violate the provisions of these Measures, engage in relevant professional services without skill certification, or engage in relevant professional services beyond the scope as specified, relevant industry authorities will not recognize them, and will deal with them with reference to the provisions of the province on practicing without qualifications or undertaking business beyond the scope of practice.
第十五条 境外持证人员违反本办法规定，被省级行业主管部门注销《海南自由贸易港境外人员技能认定合格证》的，三年内不再受理该人员的技能认定申请；造成重大安全事故的，终身不予受理。
Article 15 Where the overseas personnel violate the provisions of these Measures and are revoked the Skill Certification Certificate of Overseas Personnel in the Hainan Free Trade Port by the provincial-level industry authorities, their application for skill certification will not be accepted for three years; in case of major safety accident, their application will never be accepted again.
第十六条 境外人员提供虚假材料申请技能认定的，省级行业主管部门不予受理，并记入诚信黑名单，三年之内不得再次申请技能认定。
Article 16 Where the overseas personnel provide false materials to apply for skill certification, they will not be accepted by the provincial-level industry authorities and will be put on the credit blacklist, so that they are not allowed to apply for skill certification again for three years.
第十七条 聘用单位未按照规定报送境外持证人员专业服务信用情况的，由省级行业主管部门责令其限期改正；逾期未改的，可暂停受理该单位境外人员的技能认定申请。
Article 17 Where the employers fail to submit the Overseas Certified Personnel’s credit standing of professional services according to the rules, the provincial-level industry authorities shall order them to make corrections within a specified time limit; if they fail to make corrections within the prescribed time limit, their application for skill certification of their overseas personnel may be suspended.
第十八条 省级行业主管部门应建立境外持证人员信息通报制度，在部门网站或公共网站及时公布通过技能认定的境外人员名单及其专业服务范围、有效期限和已注销《海南自由贸易港境外人员技能认定合格证》的境外持证人员名单以及境外持证人员违规情况。
Article 18 The provincial-level industry authorities shall establish an information disclosure system for Overseas Certified Personnel, and promptly publish on the department’s website or public website the list of
overseas personnel who pass the skill certification, the scope and terms of validity of professional services, the list of Overseas Certified Personnel whose Skill Certification Certificate ofOverseas Personnel in the Hainan Free Trade Port has been revoked, as well as violations of any Overseas Certified Personnel.
第十九条 省级行业主管部门应建立境外人员执业管理政策调整机制，根据本行业的发展需要和境外持证人员专业服务情况，及时完善本行业境外人员执业管理相关规定。
Article 19 The provincial-level industry authorities shall establish a policy adjustment mechanism for the practice management of overseas personnel, and improve the relevant provisions on the practice management of overseas personnel in the industry in a timely manner according to the development needs of the industry and professional services provided by Overseas Certified Personnel.
第五章 附 则
Chapter 5 Supplementary Provisions
第二十条 省级相关行业主管部门可根据本办法规定，制定本行业境外人员执业管理实施细则。
Article 20 The relevant provincial-level industry authorities may formulate the detailed rules for the practice management of overseas personnel in the industry according to the provisions of these Measures.
国家对港澳台同胞在海南自由贸易港执业有规定的，按其规定执行。
Where it is stipulated by the State on the practice of compatriots
from Hong Kong, Macao, and Taiwan in the Port, such stipulations shall prevail.
第二十一条 本办法由中共海南省委人才发展局、海南省人力资源和社会保障厅负责解释。
Article 21 These Measures shall be interpreted by the Talent Development Bureau of CPC Hainan Provincial Committee and the Department of Human Resources and Social Security of Hainan Province.
第二十二条 本办法自公布之日起实施。
Article 22 These Measures shall take effect from the date of promulgation.
